WASHINGTON — When Congress required most Americans to obtain health insurance or pay a penalty, Democrats denied that they were creating a new tax. But in court, the Obama administration and its allies now defend the requirement as an exercise of the government’s “power to lay and collect taxes.”

And that power, they say, is even more sweeping than the federal power to regulate interstate commerce.

The usual suspects from the left are quiet on this thread. I guess they're waiting to receive their talking points before explining to us why the Obama Whitehouse isn't being audaciously two-faced. No doubt it will include some reference to Bush.

Yes, it does seem that the President said it was not a tax and now the justice department’s Plan B in court is to call it a tax just in case Plan A, the commerce clause, does not work. Sound legal strategy.

Fox must be having a great time with this.

Right, because the "universal coverage republican idea" is so germane to a discussion about Obama looking the American public in the eye and vehemently denying that it is a tax one day and then later arguing it is a tax. On second thought, I guess your search is germane if partisan flackery and deflection is on your "to do" list for the day. Scratch 'em both off...done, and done!

You brought up the "two faced" argument, I simply noted that the mandates that are in the health reform bill originate with the Republican party and they now think this aspect of the bill is evil, socialist, etc, etc. A relevant comparison of being two-faced. Kinda just like saying you are the party of fiscal discipline and then running up huge deficits when in complete control and after being handed surpluses.;)

Yes, President Obama said one thing and now the administration is claiming another in court. Enjoy!

Actuarily, the only way to make a universal coverage concept work is to compel everyone to participate so that the healthy people help pay for the unhealthy. That is why we all pay into SS and Medicare.

OTOH, the way this bill came into being ... with its back-room dealings ... do we really know what went on to produce the final product?

Actually, nothing in the legislation mandates that you buy insurance. However, if you do not you are subject to a tax. Employers face a mandate which is justified by interstate commerce considerations. States do not force a mandate but lose Federal funding if they do not go along. I think that a successful challenge is highly unlikely. However, the Court has become so political that anything is possible.
This is the point I was making months ago. I see no way for the program to go forward except by defining the penalties for not purchasing insurance as taxes. That was clear when the legislation was proposed and remains clear today.

What about Obongo lying when he said "If your happy with your current doctor and insurance you can keep them" . Now thats not the case under Obongo Care.

The answer to your question is NO, we don't know, but we are beginning to find out the impacts of the legislation. Remember Pelosi in one of her finer hours: "But we have to pass the bill so that you can find out what is in it, away from the fog of the controversy..."

Now that's how you get things done!
