    Default EPA proposes fines for building a pond

    FY This would normally go in POTUS but for the paragraph that is 4th from the end. The EPA is proposing a rule that apparently makes any pond a subject of their control and approval.

    Wyoming welder faces $75,000 a day in EPA fines for building pond on his property

    All Andy Johnson wanted to do was build a stock pond on his sprawling eight-acre Wyoming farm. He and his wife Katie spent hours constructing it, filling it with crystal-clear water, and bringing in brook and brown trout, ducks and geese. It was a place where his horses could drink and graze, and a private playground for his three children.

    But instead of enjoying the fruits of his labor, the Wyoming welder says he was harangued by the federal government, stuck in what he calls a petty power play by the Environmental Protection Agency. He claims the agency is now threatening him with civil and criminal penalties including the threat of a $75,000-a-day fine.

    I would have bet the ranch ,that couldn't happen in Wyoming !!!!!

    Wow a "sprawling 8 acre" ranch in Montana. That's unheard of!

    No, it's not, Breck - EPA considers sprawlings songbirds and is very protective of them! Just like red-winged blackbirds at field trials, sprawlings have a right to be here, too - at least according to EPA!

    Maybe you mean, when it comes to ponds, or sloughs of despond, EPA's all wet and ought to stick to West Virginia...

    Overreaching government control illustrated and getting more common all the time. Of course, there is usually the obligatory reach into the pockets of U.S. Citizens on the part of government to aid in their money grab, only so they can piss away our hard earned money for some senseless cause or project. The EPA should stay out of this guy's life as well as others like him, and go after some of the real offenders that they turn a blind eye to on a regular basis.

    Pathetic. The common folk in this country need to take back control of our collective private lives and affairs, and a good start would be by using the electoral process to remove many of the idiots now occupying the seats of lawmakers, way too many only interested in self enrichment.

    Nothing new really water management has always been a hot topic weather it is the state or the Feds. Digging a lake can effect where the downstream water ends up. Out west they are especially sensitive of this.
    The person who owns our clubs property in Florida dug a technical pond many years ago and was fined (I could be wrong about the exact amount) something like 40K and had to designate 40 acres of the property as wetlands to mitigate the pond she dug. She didn't care because she just considered it part of the cost.
    I also have a friend whose job is to do exactly this, get plans approved by the state or EPA to build ponds be it on golf courses, ranches, or even state parks. Water management is serious business.

    When we recently constructed our pond, our permit had to be approved by several agencies, including the Army Corp, because it was in a seasonal creek bed which was fed by irrigation runoff.

    I am glad we did it the right way instead of being subject to a hefty fine. It was viewed by the agencies as increasing wetland habitat.

    The rules are so complex, often people do not understand what is required to alter the landscape. Individual bureaucrats have so much power to cause pain. I am sure the Army Corp official had the discretion to have the landowner apply for the permit retroactively.

    The article goes on to say "The property owner says he followed the state rules for a stock pond when he built it in 2012 and has an April 4-dated letter from the Wyoming State Engineer’s Office to prove it."

    Aaaaaaaannndddddd.........

    "Johnson says he built a stock pond -- a man-made pond meant to attract wildlife -- which is exempt from Clean Water Act regulations."

    ahhhhhhh...but a letter and a permit are not one in the same. Being exempt and having a permit are also not one in the same necessarily.

    Why isn't this in POTUS? I know of no place in the United States that regulations are not required for pond building. I had 32 federal and tribal agencies review my request for building ponds. Approved very quickly. Knock off the government bashing!!!!!
