    so who gets charged in the murder of the MIT police officer ? is the State of Mass also going to file capitol murder charges too...I realize he can only be executed once...BUT if he pleas out a deal I want the terms to be served consecutively...

    No death penalty in Mass.

    Danny-

    There is the exception but the forces are sort of against this now. The exception was created for the "excited utterance" of a criminal....where he admits to some major incident or device before the rights are read. It's the so-called "public safety exception". However, with the Governor of MA, the head of the state police, the Mayor of Boston, and the Boston Police Commissioner all saying last Fri, "Boston is safe again"...what's the emergency. President Obama and Attny General Holder think they're going to get away with this but they may get handed their heads by the Supremes and the lad will then walk out the door.

    If 2-3 days after he was captured there still exists an emergency, what's to say that won't be true of every arrest? The public emergency exception is not in any law but rather a Supreme Ct refinement of Miranda. Thus, they're making it up as they go and that's always risky.

    Because the namby pamby's will say the poor fellow was only 19 and was influenced by his overbearing older brother. Maybe if we treat him right we can rehabilitate him and make a good citizen out of him yet

    'cause I am not as good a Christian as my Grandmother had hoped
    I would be and want him to suffer as much as possible.
    if we could kill him more than once after the 40 years I'd be for that also.

    I like that idea, except it ends up costing us way more $$$$$$$$. Can't he be charged federally due to some ATF violations?
