How much exercise is the dog getting on a daily basis?
I was kind of thinking the same thing. Either lots of exercise or lots of stimulation. I know that until recently Gunner could not handle laying around if he didn't have something to work on at some point throughout his day. I would hurry home from work and do a bunch of obedience or marks, then hurry off to get the kid at the bus stop, and then take the dogs out for a full speed run in a field. Then he'd settle down.
 
Some dogs are that way regardless of how much excersize they recieve each day. In fact, the behavior seems genetic. (I have seen this passed down from mother to daughter to grandaughter -and yet other relatives in the same living environment who do not do this)

Anyhow, the only thing you can do is teach a solid "down stay". Start off with collar and leash and work on it in the house and the yard and when he shows he understands, then you can train in the blind (when training with a group) and in the car (have someone in the back seat who can hold the leash and make corrections for the dog getting up). Corrections would be the regular downward leash jerk on a chain or pinch collar...(later you can enforce with the e-collar by putting it with the contacts on the back of the dog's neck instead of the throat)
The noise, will likely die down as the dog is made to be in the down position. However, you can give a correction with holding the muzzle shut and "no" every time he whines.. However, I have had dogs who were simply not aware they were making any noise unless they were barking or howling.
